1. Eligibility
To open a shopper account you must be at least the age of majority in your jurisdiction, or have the consent of a parent or guardian.
2. Your account
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
3. Purchases and transactions
When you purchase an item, you enter into a transaction with the merchant. BrainyMart provides the platform but is not a party to the sale between you and the merchant.
You agree to provide accurate information needed to complete your purchase and delivery or handoff of the item.
4. Prohibited conduct
You may not use the site to engage in unlawful activity, to harass or defraud others, or to attempt to gain unauthorized access to any part of the site.
5. No agency; platform role
Using the platform does not create an agency, partnership, employment, or joint-venture relationship, and does not bind the BrainyMart platform operator in any way.
6. Compliance with law
You agree to comply with all applicable laws, including those governing purchases, taxes, consumer protection, and data privacy.
7. Termination
BrainyMart may suspend or terminate a shopper account that breaches these terms, at its discretion.

9. Governing law and jurisdiction
Any dispute with the platform operator is to be resolved under the laws of Ontario, Canada, and any litigation is to occur in the jurisdiction of Ottawa, Ontario, Canada.
